1. Acceptance of Terms

By accessing or using KonnectPe's payment services, merchant portal, APIs, or any related products ("Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility

To use our Services, you must be a registered business entity in India with valid GST registration, a valid PAN, and an active bank account with an Indian scheduled commercial bank, complying with all applicable RBI guidelines.

3. Merchant Obligations

• Provide accurate, complete, and up-to-date information during onboarding
• Maintain appropriate records for at least 5 years as required by law
• Comply with PCI-DSS requirements relevant to your integration
• Not process payments for prohibited goods or services
• Notify KonnectPe immediately of any security incidents or suspicious transactions
• Honour all valid refund requests within specified timeframes

4. Payment Processing

KonnectPe acts as a payment aggregator. We reserve the right to hold funds up to 14 days for suspected fraud, decline violating transactions, adjust settlement timelines during maintenance, and withhold settlements pending dispute resolution.

5. Fees and Settlements

Transaction fees are as specified in your merchant agreement plus 18% GST. Standard merchants receive T+1 settlement; enterprise clients may qualify for T+0. Fee amendments require 30 days' written notice.

6. Prohibited Activities

• Unlicensed gambling, betting, or lottery services
• Weapons, ammunition, or explosive devices
• Counterfeit goods or intellectual property infringement
• Ponzi schemes, pyramid schemes, or fraudulent investments
• Any activity violating applicable Indian or international law

7. Data Protection

We process cardholder data under PCI-DSS Level 1 standards and comply with DPDPA 2023 and RBI data localisation guidelines. All payment data is stored exclusively within India.

8. Limitation of Liability

Total liability shall not exceed fees paid in the preceding three months. We are not liable for indirect, consequential, or punitive damages to the maximum extent permitted by law.

9. Termination

Either party may terminate with 30 days' written notice. KonnectPe may suspend immediately for breach, fraud, or regulatory requirement. Outstanding settlements continue within standard cycles post-termination.

10. Governing Law

Governed by the laws of India. Disputes subject to arbitration under the Arbitration and Conciliation Act, 1996, in Mumbai. Courts of Mumbai have exclusive jurisdiction for non-arbitrable matters.
